1. Introductory provisions
1.1. These Terms and Conditions govern our rights and obligations, as the seller, and your rights and obligations, as the buyer, if you purchase goods through the online store www.doodoo.cz.
1.2. If you are a legal entity or an entrepreneur, these Terms and Conditions do not apply to you.
1.3. If we agree on anything different from these Terms and Conditions, our agreement will take precedence.
1.4. The wording of these Terms and Conditions may exceptionally change. The version applicable to you will always be the version in force at the time of purchase of the specific goods.
2. Online store, order and conclusion of the purchase contract
2.1. All presentation of goods in the online store is for informational purposes only and does not oblige us to conclude a purchase contract.
2.2. The online store contains information about the goods, including their price and shipping costs. If the product description differs from the photos, the product description takes precedence over the photos.
2.3. To order goods, you must complete the order form, which contains:
– information about the ordered goods; the ordered goods must be “added” to the “cart”,
– the method of payment for the goods,
– information about the requested method of delivery and its price (hereinafter the “order”).
2.4. Before submitting the order, we allow you to check and change the information provided in the order. You then submit the order by clicking the “Order with obligation to pay” button. We consider the information provided in the order to be correct. After receiving the order, we will confirm the order to the e-mail address provided in the order.
2.5. We have the right to ask you for additional confirmation of the order in the case of a higher price or quantity.
2.6. The purchase contract is concluded by payment of the purchase price. By paying the purchase price, you also acquire ownership of the ordered goods.
2.7. In exceptional cases, we may cancel your order, especially if the ordered goods are not in stock.
2.8. We try to prevent such situations. At the same time, we also try to offer a large number of product variants and to combine different products. For this reason, one product may be included as part of several other products at the same time. Therefore, we cannot guarantee that all products available in the store are also in stock.
3. Price of goods and payment terms
3.1. The prices displayed in the online store are final prices.
3.2. The displayed prices include VAT if we are obliged to charge it in the country of delivery.
3.3. Product prices differ according to the country of delivery due to different VAT rates. Our system calculates them preliminarily based on your approximate location. We determine this location based on your IP address. If you use a VPN, mobile connection, roaming, corporate network or another type of connection that may distort location detection, the product price and/or shipping price may change after you enter the exact delivery address in the cart.
3.4. Product prices remain valid for as long as they are displayed in the online store.
3.5. You pay the price of the goods and shipping costs by cashless payment through the payment gateway. In the Czech Republic, you may also pay the price of the goods and shipping costs by bank transfer – QR payment.
3.6. Discounts on the price of goods cannot be combined with each other.
4. Withdrawal from the purchase contract
4.1. You need to know that you may return the goods to us (withdraw from the purchase contract under the Civil Code) only in the original, unopened and undamaged packaging. If you remove the goods from the packaging, or damage the packaging in any way, you cannot return the purchased goods afterwards for hygienic reasons.
4.2. If you do not remove the goods from the sealed packaging, you may return them within fourteen (14) days of delivery (withdraw from the purchase contract). It is sufficient if, on the last day of the period, you hand the goods over to the carrier for delivery to us. Within the same period, please let us know by e-mail at info@doodoo.cz that you wish to return the goods (withdraw from the purchase contract).
4.3. You must pay the shipping costs for returning the goods yourself.
4.4. We will refund the price of the goods within 14 days of receiving the returned goods. We will send the money back to the account from which the goods were paid.
4.5. If the goods show visible damage, we will refund the price of the goods reduced by the amount of the damage.
4.6. If we included a gift with the goods, you must return this gift together with the returned goods.
4.7. Goods may be returned only to the following address: Petr Babinec, P.O. BOX 21, Unhošť 273 51, Czech republic.
5. Transport and delivery of goods
5.1. Our obligation is to deliver the goods to the place specified by you as soon as possible after payment. Your obligation is to accept the goods upon delivery.
5.2. If you cause a situation where the goods need to be delivered repeatedly or by another method, you will have to pay the costs incurred in this way.
5.3. When receiving the goods from the carrier, check that the shipment packaging is intact. If you find any defects in the shipment packaging, notify the carrier immediately. If the shipment looks as if it has been opened, you do not have to accept it.
6. Rights arising from defective performance
6.1. Our rights and obligations, as well as your rights and obligations, regarding defective goods are governed by the laws of the Czech Republic. The relevant provisions can be found in particular in Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174 of the Czech Civil Code and in the Consumer Protection Act.
6.2. We are responsible for ensuring that, at the time you take over the goods:
– the goods have the characteristics described in the online store and which you, as the buyer, may expect from the ordered goods,
– the goods are suitable for the purpose that we state for their use or for the purpose for which such goods are usually used,
– you receive the goods in the corresponding quantity, and
– the goods comply with the requirements of legal regulations.
6.3. If, with your consent, we sell you goods with a defect at a lower price, you cannot subsequently exercise the rights under the previous paragraph. Your rights under the previous paragraph also do not apply if the defect in the goods arose as a result of wear and tear during normal use.
6.4. Under the previous paragraphs, you may exercise rights arising from a defect that appears in the goods within one month of receipt.
6.5. You may exercise rights arising from defective performance by e-mail at info@doodoo.cz and at the same time by delivering the goods.
7. Complaints and disputes
7.1. We handle any complaints you may have by e-mail at info@doodoo.cz.
7.2. You should know that the Czech Trade Inspection Authority is competent for the out-of-court resolution of any disputes between us (consumer disputes arising from a purchase contract), with its registered office at Štěpánská 567/15, 120 00 Prague 2, Czech republic, Business ID No.: 000 20 869, website: https://adr.coi.cz/cs.
7.3. You should also know that the contact point for resolving consumer disputes online is the European Consumer Centre Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Prague 2, Czech republic, website: https://www.evropskyspotrebitel.cz.
8. Personal data protection
8.1. We process your personal data for the purpose of fulfilling these Terms and Conditions, processing your order, delivering the goods, settling our mutual payments and necessary communication between us.
8.2. Other persons who receive your personal data are our subcontractors:
– WordPress, WooCommerce and, where applicable, other plug-in programs (online store system),
– Zásilkovna – Packeta, Česká pošta, s.p. (delivery service),
– Google (website analytics),
– Stripe (payment service provider),
– accountants and tax advisers (to the extent necessary to comply with legal obligations).
8.3. You have the right to the protection of your personal data and, under the law, therefore have the right to:
– access your personal data,
– rectify your personal data,
– erase your personal data,
– object to the processing of your personal data,
– data portability of your personal data,
– withdraw consent to the processing of your personal data at the e-mail address info@doodoo.cz,
– lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been violated.
9. Delivery of notices
We deliver notices to each other by e-mail. In Czech republic, also through our “data boxes”.
10. Final provisions
10.1. You should know that our relationship established by the purchase of goods in the online store is governed by Czech law, even if it contains any foreign element.
10.2. If any part of the Terms and Conditions is invalid, a provision whose meaning most closely corresponds to the invalid part will apply instead of the invalid part. The possible invalidity of any part of the Terms and Conditions does not cause the invalidity of the Terms and Conditions as a whole.
10.3. A model text for withdrawal from the purchase contract forms an annex to these Terms and Conditions.
